Please read this End-User Agreement (‘Agreement’) carefully before clicking the "I Agree" button, accessing or using https://mysvasth.com.au/ and associated mobile Platform(s) (‘Platform’). The Platform is owned and operated by [mySvasth] (hereinafter referred to as ‘Mysvasth’ or ‘Company’).
By clicking the "I Agree" button, accessing or using the Platform, you are agreeing to be bound by the terms and conditions of this Agreement.
This Agreement is a legal agreement between you (either an individual or a single entity) (hereinafter referred to as the ‘User’) and Company only and it governs the grant of license of the Platform made available to you by Company.
The Company reserves the right to change or modify this Agreement at any time and in its sole discretion. If the Company makes changes to this Agreement, the Company may notify the Users by providing the Users with notice of such changes and continued use of the Platform by the Users shall deem to be their acceptance of the revised and amended Agreement.
1. License and Establishing an Account
1.1. The Company grants you a revocable, non-exclusive, non-transferable, limited license to access, install and use the Platform strictly in accordance with the terms of this Agreement.
1.2. The User must establish an Account with Mysvasth to use the Platform and associated service. The User hereby acknowledges that their account is personal to them and they are expected to treat their account as confidential.
1.3. The User agrees to provide accurate, current and complete information about themselves as prompted by the Platform and the registration form if any. By establishing an account with Mysvasth, the User represent that they are at least 18 (eighteen) years of age, or the legal age of majority where the User resides if that jurisdiction has an older age of majority, and that they have the legal authority to enter into this agreement.
2. Trademarks and Copyright
2.1. The trademarks, logos and service marks (‘Marks’) displayed on the Platform are the property of Mysvasth and other associated parties and service providers. Users are prohibited from using any Marks for any purpose without the written permission of Mysvasth or such third party which may own the Marks.
2.2. All information and content including any software programs available on or through the Platform (‘Content’) is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Platform for commercial or public purposes.
2.3. The User further acknowledges that the Platform may contain information which is designated confidential by Mysvasth and that the User shall accordingly not disclose any information marked as such without Mysvasth’s prior written consent.
3. Copyright Notice
3.1. The Company respects the intellectual property rights of others and expects the Users of the Platform to do the same. If the User believe that any content appearing in the Platform has been copied in a way that constitutes copyright infringement, please forward the following information to the Company.
3.2. To file a copyright infringement notice, the User will need to send a written communication that includes the following to the address listed below:
3.2.1. The User’s name, address, telephone number, and email address;
3.2.2. A description of the copyrighted work that the User claim has been infringed;
3.2.3. The exact URL or a description of where the alleged infringing material is located;
3.2.4. A statement by the User that the User have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
3.2.5. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; and
3.2.6. A statement by the User, under penalty of perjury, that the above information in the User’s notice is accurate and that the User are the copyright owner or authorized to act on the copyright owner's behalf.
4. Accessing the Platform and Account Security
4.1. Mysvasth is dedicated to ensuring the accessibility, integrity and security of personal, financial, and health information (collectively, ‘User Data’). The User shall be responsible for ensuring that all persons to whom access has been granted to the Platform or associated services, including the User’s account, are aware of this Agreement, and have had the opportunity to review, accept and comply with this Agreement.
4.2. When the User select the User’s password, and/or any other piece of information as part of Mysvasth’s security procedures, the User are expected to treat such information as confidential. The User agree to accept responsibility for all activities that occur under the User’s e-mail and password. The User agree to notify us immediately of any unauthorized access to, use or disclosure of the User’s e-mail, password, or any other security violation or breach.
Mysvasth have the right to disable any e-mail, password, or other identifier at any time in our sole discretion if, in our opinion, the User have violated any provision of this Agreement (including our Privacy Policy).
4.3. Mysvasth reserve the right to withdraw or amend the Platform, in our sole discretion without notice. The Company shall not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period.
5. Payment of Booking Fee
5.1. The User who are accessing the Platform to find healthcare provider may be required to pay fees before ‘booking’ a service from the healthcare provider. Such fees (‘Booking Fees’) shall be an amount equivalent to a percentage of the estimated cost of service. The Company reserves the right to change the Booking Fee in its sole discretion.
5.2. The User is responsible for paying all fees that is owed to Mysvasth or to the service provider through the available means of payment. In no event shall the Booking Fee be refundable to the user. Except as set forth in this Agreement, you are responsible for collecting and paying any taxes associated with using Mysvasth’s services.
6. Usage of the Platform and proprietary materials
6.1. The Company grants the User a personal, limited, non-exclusive license to use the Platform. To the fullest extent permitted by applicable law, this license granted to use is non-transferable. The User may not copy (except as expressly permitted by this license and any other applicable terms, conditions, or usage rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Platform or the content therein.
6.2. The User hereby agree to register to become a member of the Platform only if the User are of sufficient legal age and can enter into binding contracts. The User are responsible for maintaining the secrecy of the User’s passwords, login name/user-id and account information at all times and the User shall be personally responsible for all any and all use of the Platform by the User and anyone using the User’s login information and password whether with or without the User’s permission.
7. Submitted Content
7.1. Mysvasth does not claim ownership of any materials the User make available through the Platform. At Mysvasth's sole discretion, such materials may be included in the Platform or associated Service in whole or in part or in a modified form. With respect to such materials the User submit or make available for inclusion on the Platform, the User grant Mysvasth a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials (as well as use the name that the User submit in connection with such submitted content).
7.2. The User hereby represent, warrant and covenant that any materials the User provide do not include anything (including, but not limited to, text, images, music or video) to which the User do not have the full right to grant the license. The Company take no responsibility and assume no liability for any submitted content posted or submitted by the User. The Company have no obligation to post the User’s comments; and reserves the right in our absolute discretion to determine which comments are published on the Platform. If the User does not agree to this Agreement, please do not provide us with any submitted content.
7.3. The User agrees that the User shall be fully responsible for the content the User submits. The User are prohibited from posting or transmitting to or from this Platform: (i) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (ii) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (iii) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. The User shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from the User’s posting of content to this Platform.
8. Restricted Uses
8.1. The User agree not to use the Services or Platform in any unlawful, infringing, tortuous or harmful manner; in any way that violates another party's intellectual property, privacy or other rights; or in any way that otherwise interferes with the operation, use or enjoyment of any service, system or other property.
8.2. Without limiting any of the foregoing, the User agree that the User shall not (and the User agree not to allow any third party to):
8.2.1. to make any fraudulent Platforms.
8.2.2. for any purpose that is unlawful, illegal or forbidden by law or to promote or advocate any illegal activity including but not limited to copyright infringement or computer misuse.
8.2.3. to remove any copyright and other proprietary notices contained in any content on the Platform.
8.2.4. to conduct any activity that is harmful or detrimental to the Platform as solely determined by Mysvasth;
8.2.5. to post any information or content that is obscene, sexually explicit, indecent, defamatory, hateful or intolerant in nature or in violation of the laws of any jurisdiction.
8.2.6. to falsely represent the itself as another person or as a representative of a business or entity that the User do not actually represent or give the impression that posts come from a healthcare professional, if that is not the case;
8.2.7. to change the content in any capacity or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose.
8.2.8. to transfer the content to any other person unless the User give such person notice of, and such person agrees to accept, the obligations arising under this Agreement.
8.2.9. to use any automated scripts or “robots” to access, copy, or manipulate any content provided on this Platform.
8.2.10. to engage in denial of service attacks upon the servers that publish this Platform.
8.2.11. to promote or incite any violence.
8.2.12. to promote or provoke any discrimination (including but not limited to that which is based on race, sex, religion, nationality, disability, sexual orientation or age).
8.2.13. to breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
8.2.14. register more than one account or create any alternative accounts.
8.2.15. engage in any activity that in our opinion could be harmful to the health or wellbeing of another user or which raises any clinical safety concerns; and
8.2.16. spam any of the discussions, leave repetitive comments.
9. Suspension and termination of Account or access to Platform/Services
9.1. Mysvasth will determine, at its discretion, whether there has been a breach of this Agreement through the User’s use of the Platform. In our view, when a breach of this Agreement has taken place, then we may take such action as we deem appropriate, which may include any or all of the following actions:
9.1.1. Temporary suspension or permanent withdrawal of the User’s right to use the Platform.
9.1.2. Temporary or permanent removal of any posting or material uploaded by the User to our Platform.
9.1.3. Issuing a warning to the User.
9.1.4. Legal proceedings against the User for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
9.1.5. Further legal action against the User.
9.1.6. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
9.2. We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are examples, and we may take such other actions as we may reasonably deem appropriate.
10. Representations by the User
10.1. The User hereby agrees and warrants the following:
10.1.1. Mysvasth is a Platform.
i. Mysvasth is a technology platform that aims to provide easy access to healthcare providers. Mysvasth does not refer or suggest Users to any specific healthcare provider but may provide information about the healthcare providers including, but not limited to, locations, accreditations, number of beds, specializations. The information presented on the Platform is provided by the healthcare providers and the Platform does not constitute and should not be considered as an endorsement or recommendation of the quality, qualifications or service level of any service provider. Mysvasth does not provide any medical consultation or medical treatment (hereinafter referred to as ‘Healthcare Services’) of any nature.
ii. Mysvasth enables Users to search for healthcare providers and facilitates communication between the healthcare provider(s) and the Users. Each User should use the resources and facilities available to conduct their own research and comprehensive due diligence of any healthcare provider prior to availing their services. If the User elects to proceed with a healthcare provider, Mysvasth does not assume any responsibility, obligations or liabilities by the User using any Healthcare Service from a healthcare provider.
iii. The cost of Healthcare Services is between the User and a service provider. Mysvasth’s scope is to facilitate Users to get information and if required, book healthcare Services through the Platform. Mysvasth provides an estimated cost of Healthcare Service and cannot be held liable for quotations given to the User(s).
iv. The Platform may show the User sponsored results on the Platform, including at the top of search results (‘Sponsored Results’). In such instances, Mysvasth may receive additional fees from healthcare providers or healthcare organizations for providing Sponsored Results. Sponsored Results shown through the Platform are not, and should not be considered, an endorsement or recommendation by Mysvasth of the Service provider.
10.1.2. Mysvasth does not provide medical advice. The Content that the User obtain or receive from Mysvasth, its employees, contractors, partners, sponsors, advertisers, licensors or otherwise through the Platform, is for informational, scheduling and payment purposes only. While we hope the content is useful, it is not intended as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. Do not disregard, avoid or delay obtaining medical advice from a qualified healthcare provider, under any circumstance. Do not use the services for emergency medical needs. Nothing stated or posted on the Platform or available through any services is intended to be, and must not be taken to be, the practice of medicine, dentistry, nursing, or other professional healthcare advice, or the provision of medical care.
11. Reviews, Feedback and Testimonials
11.1. Mysvasth may ask Users to provide reviews, feedback, or testimonials, hereinafter referred to as “Feedback”. the Feedback should not be intentionally damaging, offensive or malicious. The Feedback may be used for internal purposes but could also be used publicly on the Platform. Mysvasth shall not entertain any false Feedback.
11.2. Mysvasth cannot entertain claims about the accuracy or effectiveness of a service provider’s services. Further any allegations of medical negligence or criminal activity should be reports to the appropriate authorities. The User is responsible to ensure the Feedback is accurate and not misleading or providing false information which could have legal ramifications. The Feedback should not include any contact information within the review and should not mention and staff members by name
12. Links to Third Parties
12.1. As a matter of convenience to the User, Mysvasth may provide links to various third-party Platforms on the Platform. If the User use any of these external Platforms, the User may be directed/redirected to such external Platform and may leave the Platform.
12.2. If the User decides to visit any such external link, the User agrees to do so at the User’s own risk, responsibility and liability. Mysvasth makes no warranty or representation regarding, and does not endorse, any Platform linked to the Platform or the information appearing thereon or any of the products or services described thereon. Mysvasth does not endorse or represent any service provider listed on the Platform. Please carefully review the terms of service and privacy policies of all such Platforms prior to usage.
13. Warranty and Disclaimer
13.1. The Platform and Services provided on the Platform are provided on an "AS IS" and "AS AVAILABLE" basis. Mysvasth expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy, as well as all warranties arising by usage of trade, course of dealing, or course of performance.
13.2. Mysvasth makes no warranty, and expressly disclaims any obligation, that: (a) the Platform content will be up-to-date, complete, comprehensive, accurate or applicable to the User’s circumstances; (b) the Platform will meet the User’s requirements or will be available on an uninterrupted, timely, secure, or error-free basis; (c) the results that may be obtained from the use of the Platform or Services offered through the Platform will be accurate or reliable; or (d) the quality of any products, services, information, or other material obtained by the User through the Platform will meet the User’s expectations.
13.3. The Platform content may contain inaccuracies and typographical errors. Mysvasth does not warrant the accuracy or completeness of any such content or the reliability of any advice, opinion, advertisement, statement, memorandum or other information displayed or distributed through the Platform. The User acknowledges that any reliance on any such opinion, advice, statement, memorandum or information shall be at the User’s sole risk. Mysvasth does not endorse or represent any partner or service provider listed on this Platform.
13.4. Please use common sense when viewing any claims made by any third party that may be published on the Platform or that the User may learn indirectly via our Platform and verify all claims with the User’s own independent health Service provider. We are not responsible for the claims of any advertisements that appear on our Platform.
13.5. Mysvasth makes no representation that the usage of this Platform, or the content provided herein, will not violate the laws of the User’s local jurisdiction. The User is responsible for the laws of the User’s jurisdiction. Do not use this Platform if such usage violates the law of the jurisdiction in which the User resides.
13.6. The User agree to assume all responsibility regarding whatever decision the User make about obtaining service and the User agree to hold us harmless from any claims arising from services the User receive from any service providers regardless of the User’s location when the User receive such a consultation.
14. Limitation of Liability
14.1. Mysvasth (including its officers, directors, employees, representatives, affiliates, partners and providers) will not be responsible or liable for (a) any injury, death, loss, claim, act of god, accident, delay, or any direct, special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arise out of or is in any way connected with (i) any failure or delay (including without limitation the use of or inability to use any component of the Platform), or (ii) any use of the Platform or content, or (iii) the performance or non-performance by us or any partner or service provider, even if we have been advised of the possibility of damages to such parties or any other party, or (b) any damages to or viruses that may infect the user’s computer equipment or other property as the result of the user’s access to the Platform or the user’s downloading of any content from the Platform.
14.2. Mysvasth cannot be made liable or responsible for any delay, default, failure, improper services / deficiency in service(s) provided by the Service provider and / or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever which may arise due to any act of negligence, deficiency or default in service, of the management or employees of the Service provider.
15. Indemnity
15.1. The User hereby agrees to defend, indemnify and hold harmless Mysvasth (and each of our officers, directors, members, employees, agents and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable attorneys’ fees, arising out or relating to (a) the User’s use of, or conduct in connection with, our Services; (b) any Feedback the User provide; (c) the User’s violation of this Agreement; or (d) the User’s violation of any rights of any other person or entity. If the User are obligated to indemnify us, we will have the right, in our sole discretion, to control any action or proceeding (at our expense) and determine whether we wish to settle it.
16. Miscellaneous
16.1. Assignment. The User may not assign or otherwise transfer the User’s rights or obligations under this Agreement. Mysvasth may assign its rights and duties under this Agreement without any such assignment being considered a change to this Agreement and without any notice to the User. If we fail to act on the User’s breach or anyone else's breach on any occasion, we are not waiving our right to act with respect to future or similar breaches.
16.2. Entire Agreement. This Agreement, together with those agreements and policies made a part of this Agreement by reference, make up the entire agreement between Mysvasth and the User relating to the User’s use of the Platform, and replace any prior understandings or agreements (whether oral or written) regarding the User’s use of the Platform.
16.3. Waiver. The failure of any party to enforce at any time any of the provisions of this agreement shall not be construed to be a waiver of the right of such party thereafter to enforce any such provisions.
16.4. Governing Law and Disputes. The laws of [New Jersey, USA] without regard to its conflict of laws will govern this Agreement, as well as the User’s and our observance of them. If the User takes any legal action relating to the User’s use of the Platform or this Agreement, the User agree to file such action only in the [New Jersey, USA]. In any such action or any action, we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the legal action, including but not limited to costs, both taxable and non-taxable, and reasonable attorney fees.
16.5. Severability. If any clause, sentence, paragraph or part of this agreement, or the Platform thereof to any person, shall for any reason be adjudged by a court of competent jurisdiction to be invalid, such judgment shall be limited and confined in its operation to the clause, sentence, paragraph or part thereof directly involved in the controversy and remainder of this agreement will continue in full force or effect.
16.6. Headings. Headings and titles in this agreement are for reference purposes only and do not constitute part of this agreement and are of no legal force and effect.

[mySvasth] (hereinafter referred to as ‘Mysvasth’ or ‘Company’) manages https://www.mysvasth.com/ and associated mobile application(s), if any (hereinafter collectively referred to as ‘Platform’). This Privacy Policy applies to all users of the Platform (hereinafter referred to as ‘User’).
The purpose of this Privacy Policy (hereinafter referred to as ‘Policy’), which may be amended from time to time, aims to provide you with an understanding on how we collect, use and disclose the information you provide to us.
